The National Labor Relations Act (NLRA) promotes collective bargaining between labor and management and ensures workers the right to organize and join a union without fear of reprisal. The Act preempts state law claims that are based on conduct that is protected or prohibited by the NLRA. The National Labor Relations Board (NLRB) was created to enforce the NLRA. Policies prohibiting workplace solicitation and distribution of literature are used by employers to prohibit employees from promoting non-job-related causes at work and are often effective in curbing union organizing campaigns.
