Employers regularly receive medical information from many sources and for a variety of reasons. For example, an employee may submit documentation of their medical condition along with a request for medical leave. Or there may be workers’ compensation reports that provide details about an employee’s on-the-job injury. An employee’s request for a reasonable accommodation for a disability may require documentation from the employee’s healthcare provider. Most employers know that federal and state laws have specific confidentiality requirements that impose obligations on employers to protect employees’ medical information. Having a policy that restricts access to medical records will help employers comply with the law and will make employees aware of the employer’s obligations and the protections that the employer has put in place.
