What to expect from Trump EEOC
Based on the first Trump administration, the Equal Employment Opportunity Commission (EEOC) is expected to substantially decrease its enforcement efforts, including litigation against employers. EEOC Commissioner Andrea Lucas, who—as the only Republican—is expected to become Acting Chair, has been very critical of employers’ diversity, equity, and inclusion (DEI) efforts and the EEOC’s support for those programs. With Stephen Miller becoming the president’s deputy chief of staff, the EEOC will be under substantial pressure to increase its investigations of major corporations’ DEI programs. Although the Trump administration may want to revise the EEOC’s Pregnant Workers Fairness Act (PWFA) regulations and harassment guidance, the agency won’t be able to do so until it has a Republican majority.

EEOC recovered $700M in FY2024. The EEOC announced it had secured nearly $700 million for victims of discrimination in fiscal year (FY) 2024, a 5% increase over FY 2023 and the highest monetary recovery in recent history. This amount includes over $469.6 million for 13,516 workers in the private sector and state and local government workplaces through mediation, conciliation, and settlements during the administrative process, including:
