FAR Council files ICR for new FAR clause
The Federal Acquisition Regulation (FAR) Council published an information collection request (ICR) with the Office of Management and Budget (OMB) to ensure contractors provide information required by Executive Order (EO) 14398. The ICR restates the provisions from EO 14398 that contractors must furnish all information and reports—including providing access to books, records, and accounts, as required by the contracting office—for purposes of ascertaining compliance with the clause; must report any known or reasonably knowable conduct by subcontractors that may violate the clause; and must inform contracting officers if a subcontractor sues the contractor and the suit puts the clause’s validity at issue. The ICR doesn’t provide any more specific information about what contractors will be required to provide to show compliance.
The FAR Council estimates in the ICR that the public burden will affect 1,365 respondents providing five responses, for 6,825 total responses annually. Whether this means contractors can expect 1,365 or 6,825 audits annually is unclear. Contractors have until July 6 to provide comments.
