EEOC Vice Chair Samuels provides guidance to employers

Equal Employment Opportunity Commission (EEOC) Vice Chair Jocelyn Samuels spoke to an employer association and covered a wide range of topics on which the commission is focused:

  • The EEOC is working on additional guidance for the Pregnant Workers Fairness Act, which goes into effect on June 27, 2023.
  • Pay data collection is still on the agenda once there’s a third commissioner.
  • Employers can expect more guidance on the use of artificial intelligence (AI) in employment decisions.
  • While the Supreme Court’s upcoming decisions in Harvard and UNC apply to college admissions decisions, the breath of the decisions and subsequent fallout may impact diversity, equity, and inclusion (DEI) programs as reflected in the recent request to the EEOC to investigate Mars Candy’s hiring practices.
  • The Supreme Court’s decision in Groff v. DeJoy may not completely reverse the current religious accommodation requirements.
  • The EEOC’s recent guidance on harassment in federal agencies can be useful for private employers.
