EEOC holds public hearing on EEO-1 rescission

On August 11, 2026, the Equal Employment Opportunity Commission (EEOC) held a public hearing on the notice of proposed rulemaking (NPRM) to rescind the EEO-1 through EEO-6 workforce demographic data collection and reporting requirements (and related recordkeeping rules). Section 709 of Title VII of the Civil Rights Act of 1964 requires the EEOC to hold a public hearing on any changes to the requirement to report demographic data. 

Twenty-two speakers testify 

Opening the hearing, EEOC Chair Andrea Lucas announced that all those who requested to speak were allowed to speak but that, contrary to normal procedure, the commissioners wouldn’t ask any questions. Out of 22 speakers, 15 opposed the proposed rescission, with six speakers supporting the proposal and one speaker neutral on the rescission but asking the EEOC to provide guidance on the collection of demographic data for employers.
