EEOC FY2026 litigation matches Trump agenda
The EEOC filed only slightly more lawsuits in fiscal year (FY) 2026 (97) than in FY2025 (93). In FY2026, there were 38 disability-related lawsuits and 52 Title VII lawsuits. Over 15% of the lawsuits were religious discrimination, aligning with Chair Andrea Lucas’s emphasis on religious liberty. The EEOC continued to push Pregnant Workers Fairness Act (PWFA) protections with 12 lawsuits. After filing only three race/national origin cases in FY2025, the agency filed 15 in FY2026, but a number of them alleged discrimination against White/ American workers.
As FY2026 ended, the EEOC continued its focus on Trump administration priorities including settling with the city of O’Fallon, Illinois, over its failure to provide a locker room for women only and with Generac for failing to accommodate the religious beliefs of an employee who asked to be exempt from using a transgender employee’s preferred pronouns. It also sued Sibitalent Corp. for discriminating against American workers in favor of H-1B candidates and filed a subpoena enforcement action against Hyundai for its refusal to share employee information including nationality of its workers as part of its investigation alleging it hired Korean workers over equally or more qualified American workers.
