EEOC announces partnership with DOL on Project Firewall

On November 25, the Equal Employment Opportunity Commission (EEOC) announced its partnership with the Department of Labor (DOL) on Project Firewall, a project to combat illegal national origin discrimination, particularly against American workers. The DOL announced the partnership on November 24, stating it will lead to enhanced federal enforcement against discriminatory hiring practices.

EEOC Chair Andrea Lucas said that as part of the initiative, the agency has released new educational materials, including the national origin discrimination fact sheet to help employers and workers understand their rights and responsibilities under Title VII of the Civil Rights Act of 1964.

Legal challenge to EEOC position on disparate impact dismissed

The D.C. federal district court dismissed the lawsuit filed by former EEOC General Counsel Karla Gilbride against the EEOC on behalf of a former Amazon worker alleging the agency unlawfully refused to investigate charges based on the disparate impact theory, finding the worker didn’t have standing. The U.S. district court said the worker had “not shown she suffered a judicially cognizable injury from the commission’s allegedly unlawful closure of her investigation,” and even if she had, she failed to show “a favorable ruling by this court would redress that injury.”
