Administration policies arrive at the NLRB
With the prospect of a third Republican member now a reality, the National Labor Relations Board (NLRB) general counsel (GC) is taking clearer steps to put the administration’s employer-friendly policies in place.
Third Republican member means Board can reverse precedents
When GC Crystal Carey took office, many in the business community were surprised by her failure to issue a “guidance” memo outlining her office’s intentions to identify and reverse some of the most controversial, precedent-breaking, and pro-union rulings of the Biden/ Abruzzo Board. This policy was likely influenced by the fact that the Board didn’t have the votes to reverse or establish precedents.
With the nomination of James Macy to be a third Republican Board member, that impediment has been removed, and a different course has already taken shape (although when the meandering Senate will vote to confirm Macy’s nomination is unknown).
