What Idaho's pay period law says about pay dates landing on holidays

January 2021 employment law letter
Authors:
Jason R. Mau, Parsons Behle & Latimer

Q If a pay date lands on a holiday, when do we need to pay our employeesbefore the holiday or on the next business day after the holiday?

Under Idahos wage claim law, and under most states similar laws, employers are required to pay all wages due an employee on a preceding workday if the regular payday falls on a nonworkday. A holiday is a nonworkday under the law.

Idahos wage claim law provides additional protections for employees, including requirements for at least one pay period per month that must be made no more than 15 days after a pay period ends. Failure to meet the requirementsand a failure to pay your employees on the business day preceding a payday falling on a holidaycan result in a civil penalty.

Jason R. Mau is an attorney in the Boise office of Parsons Behle & Latimer. He can be reached at 208-562-4898 or jmau@parsonsbehle.com.
