Two new Maryland employment laws to take effect on October 1
During this year’s legislative session, the Maryland General Assembly passed a statute that will require employers to disclose wage information any time they post a job listing, as well as a new law mandating that employers provide employees with certain data as part of their pay statements each time wages are paid. Both laws are set to take effect on October 1.
Pay transparency in job postings
The new pay transparency legislation enacted this year (House Bill 649/Senate Bill 525) imposes an affirmative obligation on Maryland employers to include information about the wage range for any position the employer posts in an internal or external forum. Previous law required Maryland employers to disclose such information only upon request by a candidate, but the new law requires you to disclose it as part of any job posting.
You will now be required to disclose the “wage range” for a position as part of the posting. The statute defines the “wage range” for a position as the minimum and maximum hourly rate or salary as set in good faith by the employer. The statute further specifies that you may determine the wage for a particular position by reference to any one of the following:
