Smile! You’re on camera: Posting signs is sufficient notice of security videos

June 2022 employment law letter

Q         We plan to install security cameras in the production area of our nonunion food packaging facility because of an increase in damaged product and safety incidents. Can we post signs at all entrances stating surveillance cameras are in use, or do we need to have each employee sign a waiver?

A   It’s generally legal to use security cameras in the workplace, so long as they aren’t in an area where employees have a reasonable expectation of privacy, such as the restroom. It would be sufficient to post signs at all entrances stating surveillance cameras are in use.

While you can have each employee sign a waiver as an additional precaution to potential privacy concerns, it isn’t required by Texas law.
