New York State issues new posting and notice requirements in 2024
2024 brought with it a few new posting and notice requirements for employers in New York State, keeping employees informed about the state’s new minimum wage rates and providing them with a record of employment when leaving an employer.
New minimum wage poster
Employers in New York State in all industries other than building services, hospitality, and farming must post, in a visible location, a new 2024 minimum wage poster for “miscellaneous industry” employees. The new poster sets forth the minimum hourly wage rates for employees, based on their work location, that became effective on January 1, 2024. As we reported in December 2023, the minimum wage increased this year to $16 per hour for workers in New York City and Nassau, Suffolk, and Westchester Counties, and to $15 per hour in the rest of New York State.
Expanded record of employment form requirement
In addition, because of amendments to New York’s Unemployment Insurance Law that became effective late last year, New York employers must give all departing employees a record of employment form. Here’s a link to the form: https://dol.ny.gov/system/files/documents/2023/11/ia12.3_0.pdf.
