Navigating the Third Rail: Avoiding discrimination claims in polarized times
Controversial political topics can permeate workplace dynamics and escalate into litigation, especially during polarized times. An understanding of relevant laws and strategies for navigating these issues will help employers avoid costly consequences.
Background
Controversial global and political issues often affect workplaces, and mishandling communications surrounding those issues can lead to litigation. A recent Wall Street Journal report reveals how a counseling practice in Dallas encountered lawsuits, ruptured relationships, and loss of clients after poorly managing communications surrounding the October 7 attacks in Israel and war in Gaza.
About a year after the 2023 attacks in Israel, a non-Jewish therapist asked her two Jewish colleagues for advice on how to treat a Jewish client struggling with rising antisemitism. This discussion took place during a weekly meeting, where the group often discussed political issues and treatment of clients from different backgrounds. However, the owner of the practice, who is half-Palestinian, stated that the Jewish therapists’ advice would be unhelpful and one-sided, and left the meeting. She then sent out an email prohibiting further discussion of the Israeli/Palestinian conflict and political discussion in general, claiming the topic caused her personal pain.
