Maine has enacted L.D. 54, "An Act to Require Employers to Disclose Pay Ranges and Maintain Records of Employees’ Pay Histories,” with compliance required to begin on July 29, 2026. The law creates three core obligations for employers: pay range disclosure in job postings, pay range disclosure upon employee request, and expanded recordkeeping requirements.

Job postings

Employers with 10 or more employees must include the prospective range of pay they anticipate offering for a posted position.

·     A “posting” is defined as any solicitation intended to recruit applicants for a specific position and includes the desired qualifications.

·     For positions solely based on commissions, the posting must state that the role is solely commission-based.

·     The requirement applies to postings issued directly by employers or through third-party recruiters.

·     Both electronic and printed postings apply.
