Good news for NV businesses: 9th Circuit affirms keeping arbitrable claims out of court

Arbitration clauses offer a private and often speedy forum in which to resolve employment disputes. Given that many courts are still backlogged from the COVID-19 pandemic, and because legal proceedings have become part of the permanent public record (unless there’s a reason to seal the court record), many businesses are willing to take on the often substantial cost of arbitration to resolve claims quickly, quietly, and out of the public eye.
