Court stops enforcement of diversity training EO 13950
Before President Joe Biden's rescission of President Donald Trump's Executive Order (EO) 13590, the federal district court in northern California on December 22, 2020, issued a nationwide preliminary injunction blocking enforcement of the EO against federal contractors and subcontractors. The court found the EO violated the Free Speech Clause of the First Amendment and was so vague that it violated the Due Process Clause. The Office of Federal Contract Compliance Programs (OFCCP) responded by closing its investigations into alleged violations of the EO and shut down the OFCCP's hotline for complaints (https://www.dol.gov/agencies/ofccp/faqs/executive-order-13950).
Proposed AAP verification comment period extended
The OFCCP has extended the comment period for its proposed AAP Verification proposal (https://www.federalregister.gov/documents/2020/12/29/2020-28679/agency-information-collection-activities-submission-for-omb-review-comment-request-affirmative) to January 28, 2021, because it had received only 15 comments by its initial November 13, 2020, deadline.
