Typically, employers winning employment discrimination claims rely on legitimate, nondiscriminatory reasons for the challenged decision. A recent decision from the Louisiana 4th Circuit Court of Appeals counsels employers to think twice before relying on reasons that—though they may be legitimate and nondiscriminatory—couldn’t have been relied on in making the employment decision based on testimony or documents in the record of the case.
